Funding Compliance Office provides independent workforce, funding compliance, governance, and audit-readiness support services to organisations delivering funded programs.

We do not make compliance determinations, approve or certify funding, guarantee audit outcomes, guarantee funding approvals or renewals, or act on behalf of regulators or funding bodies.

All Services are provided for support and preparedness purposes only.

Final responsibility for compliance, reporting, governance, and funding obligations remains with the client organisation.

3. Eligibility and Authority

By using the Services, you represent and warrant that you are at least 18 years of age, you have authority to bind the organisation you represent, and any purchases or engagements are made for organisational use only.

4. Accounts and Information Accuracy

To access certain Services, you may be required to provide organisational, billing, or contact information.

You warrant that all information provided is accurate, current, and complete, and that you will promptly update information if it changes.

You are responsible for safeguarding account credentials and all activity conducted under your account.

5. Orders and Engagements

Any order, booking, or engagement submitted through the website constitutes an offer to purchase Services.

We reserve the right to accept or decline engagements at our discretion, request additional information before acceptance, or decline work where conflicts, risk, or capacity issues arise.

An engagement is not confirmed until we expressly accept it and payment (if applicable) is received.

6. Fees and Payment

Unless otherwise agreed in writing, all fees are stated in Australian dollars, exclusive of GST, and payable within 14 days from the invoice date.

Late payment may result in suspension or termination of Services.

7. No Reliance and No Guarantee

Information provided through the Services is general in nature and does not constitute legal, financial, or regulatory advice. It must not be relied upon as determinative of compliance status.

You acknowledge that compliance outcomes depend on third-party decisions, government and funding requirements may change at any time, and audit and funding outcomes are outside our control.

8. Client Responsibilities

Clients are responsible for providing accurate, complete, and timely information, implementing recommendations provided, maintaining internal governance and oversight, and ensuring compliance with all applicable laws and funding agreements.

We are not responsible for outcomes arising from inaccurate or incomplete information supplied by the client.

9. Intellectual Property

All templates, frameworks, systems, methodologies, and content provided by us remain our intellectual property unless otherwise agreed in writing.

Clients are granted a non-exclusive, non-transferable licence to use deliverables for internal organisational purposes only.

Materials must not be shared externally, resold, redistributed, or repurposed for third-party use.

10. Confidentiality

We treat client information as confidential and will only disclose it with client consent, as required by law, or to professional advisers under confidentiality obligations.

Clients agree to maintain confidentiality over our proprietary materials.

11. Privacy

Personal information is handled in accordance with Australian privacy laws, our Privacy Policy, and Shopify’s Privacy Policy where applicable.

12. Third-Party Tools and Links

The Services may include links to third-party websites or tools. We do not control and are not responsible for third-party content, services, or actions. Use of third-party services is at your own risk.

13. Relationship with Shopify

Funding Compliance Office is powered by Shopify.

All transactions are between you and Funding Compliance Office. Shopify is not responsible for service delivery, advice, outcomes, or disputes.

You release Shopify and its affiliates from all claims related to your use of the Services.

14. Feedback

Any feedback you submit may be used by us without restriction or compensation. You warrant that feedback does not infringe third-party rights and is not misleading or unlawful.

15. Prohibited Use

You must not misrepresent our authority or role, use the Services unlawfully, interfere with website functionality, scrape or exploit content, or impersonate regulators or auditors.

We may suspend or terminate access for any breach.

16. Termination

We may suspend or terminate Services for breach of these Terms, non-payment, or where continuing engagement creates unacceptable risk.

Termination does not affect accrued payment obligations or confidentiality provisions.

We disclaim all warranties, express or implied, including fitness for purpose, accuracy, or completeness.

18. Limitation of Liability

19. Indemnity

You agree to indemnify and hold harmless Funding Compliance Office and its personnel from claims arising from breach of these Terms, misuse of the Services, or reliance on information contrary to these Terms.

20. Governing Law

These Terms are governed by the laws of Australia, and the courts of the applicable Australian state or territory have exclusive jurisdiction.
